Rachael Lewis Anna (CIPP/US, CIPP/E, CIPM) is a Member of Wyche’s Litigation Team.  Her practice focuses on complex business litigation and data protection. She has represented clients in antitrust, trade secret, unfair trade practice, False Claims Act, healthcare, contractual, and professional malpractice disputes.

Through her work on bet-the-company cases, and also directing an electronic discovery and information security service business, Rachael has developed a deep understanding of complicated issues facing clients who manage large amounts of data. She regularly advises clients regarding data protection, privacy, information management and security, electronically stored information, and discovery matters. She works with clients and other outside counsel to coordinate discovery across litigation matters and provide consistent, defensible strategies for managing information subject to discovery. She has extensive experience with investigations and litigation that involve forensic examination of electronically stored information. Rachael is a Certified Information Privacy Professional (United States and Europe), a Certified Information Privacy Manager, and a member of The Sedona Conference’s Data Security and Privacy Liability Working Group 11.

Rachael’s past cases include class actions and governmental investigations involving numerous industries, from automotive parts and memory chips to hospitals and employee wages. She has defended clients against antitrust claims and in government investigations led by the U.S. Department of Justice, the Federal Trade Commission, and state authorities. Rachael advises clients on how to mitigate antitrust risk and on whether transactions will raise issues with federal and state antitrust enforcers.

Prior to joining Wyche, Rachael practiced with firms in Greenville, SC, Washington, DC, and Chicago, IL. Rachael earned a Bachelor of Arts and a law degree from Wake Forest University. She is based in Wyche’s Greenville office.

  • Defended numerous international and US companies in government investigations, multidistrict class actions, and lawsuits alleging conspiracy to fix prices and reduce output in various jurisdictions.
  • Defended chocolate confectionery company in class action price fixing litigation, winning summary judgment for client.
  • Represented health care systems in Certificate of Need litigation and contractual disputes.
  • Represented clients in trade secret litigation.
  • Defended health care systems in preliminary injunction proceedings and administrative litigation brought by the Federal Trade Commission.
  • Defended AmLaw100 law firm in legal malpractice lawsuit.
  • Defended one of largest dialysis providers in Sherman Act Section 2 monopolization claims.
  • Defended international defense contractor against federal and state law antitrust claims.
  • Defended biopharmaceutical company against alleged illegal tying of drug treatment.

Counseling

  • Advised clients on pre-litigation and retention policies, the implementation of efficient and cost-effective technology solutions, and the creation of defensible and repeatable discovery workflows.
  • Coordinated the strategic and tactical execution of discovery efforts across a portfolio of matters for international manufacturer.
  • Advised companies on antitrust and competitive risk associated with mergers and acquisitions, joint ventures, collaborations between competitors, distribution practices, advertising, pricing, competitor information exchanges, and participation in trade associations.

  • Obtained regulatory clearance in multiple complex acquisitions, often involving Second Requests, for numerous clients.
  • Responded to Federal Trade Commission and Department of Justice Civil Investigative Demands.
  • Prepared Hart-Scott-Rodino filings and advocated on behalf of clients before the Federal Trade Commission and Department of Justice.
  • Represented senior executives in meetings and investigational hearings before the Federal Trade Commission and Department of Justice.
